Nintendo has lost a court case against their use of glasses-free 3D on the Nintendo 3DS. A lawsuit had been filed back in 2011 by Seijiro Tomita of Tomita Technologies USA, arguing that he had patented the 3D technology. He said he had presented it to Nintendo for use on their next handheld before the Nintendo 3DS was released, but Nintendo declined the offer. Yet it seems they used it anyway...
Nintendo must now give Seijiro Tomita 1.82% of the wholesale price for the 3DS on each console sold. Source
We haven't heard about Nintendo actually losing a case for a really long time, so that surprises me. I guess Nintendo is going to be losing their profit on the 3DS, it is already selling for a much lower price than it costs to create the 3DS.
